The petitioner is accused in connection with Birpur P.S. Case No. 29 of 2017, registered under Section 394 of the Indian Penal Code.
The accusation is that in course of returning of informant, Sanam, along with his friend on motorcycle to his house, in the way, two persons came on motorcycle from the back and stopped the informant and carried him forcibly boarding on motorcycle and friend of the informant also proceeded with the motorcycle behind the informant. Both miscreants carried the informant at lonely place and cause assault to him and his friend.
Patna High Court Cr.Misc. No.18604 of 2017 (2) dt.04-05-2017 On query, informant came to know that the motorcycle was being driven by Jitendra Kumar Sinha @ Guddu (petitioner). Thereafter, informant came to know that one person was kept at police station then he reached at police station and identified that persons as one of the miscreants, who disclosed his name as Guddu. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. Further submission is that petitioner has no criminal antecedent and is in custody since 20.02.2017. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Birpur, Supaul, in connection with Birpur P.S. Case No. 29 of 2017. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
