2. The petitioner seeks regular bail in connection with Chakand P.S. Case No. 73/2024 lodged on 27.03.2024 under Sections 147, 148, 149, 302, 201 of the Indian Penal Code.
3. As per the prosecution case, F.I.R. has been lodged against four named accused persons including the present petitioner with allegation that they have assaulted the informant son with lathi and rod due to which his son was died.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the antecedent of the petitioner is clean and he is in custody since 28.03.2024. He also submits that the petitioner's name has been figured in this case only by the virtue
Patna High Court CR. MISC. No.68742 of 2024(2) dt.01-10-2024 2/2 of the confessional statement made by the accused himself before the villagers. Therefore, according to him this case is of hearsay evidence and cannot be treated as correct.
5. Learned APP for the State opposes the prayer for bail and submits that during the investigation, material has come against the petitioner is different paragraph and police has submitted charge-sheet against the petitioner.
6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named by granted bail after framing of charge, if the charge is not framed yet and on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.- Xth, Gaya in connection with Chakand P.S. Case No. 73/2024 subject to the condition laid down under Section 437(3) of the Cr.P.C.
