ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 28.05.2019 in connection with Gamhariya P.S. Case No.63 of 2014 registered for the offence under Sections 147, 148, 149, 323, 341, 324, 307, 302 and 504 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is said to be present at the place of occurrence, yet no specific overt act has been attributed to him and at best, he may be treated to be a member of the crowd. It is further submitted that that the present petitioner has been dragged into the controversy for no fault of his and has no criminal antecedents.

Considering the aforementioned facts and
