====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 02-01-2019 Heard Sri Uday Kumar, learned counsel for the petitioner and Smt. Sahin Begum, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 04.09.2018 has prayed for grant of bail in connection with Sheohar P.S. Case No. 147 of 2014, registered for the offence under Sections 395/ 397 of the Indian Penal Code, 1860. It was submitted by learned counsel for the petitioner that petitioner has been made accused only on the basis of confessional statement of co-accused. He further submits that petitioner was never put on Test Identification Parade and other number of accused persons have already been granted bail by

Patna High Court Cr.Misc. No.70380 of 2018(3) dt.02-01-2019 2/3 this Court. Learned counsel for the petitioner has specifically referred to Annexure - 2 to the petition to show that one Keshav Singh @ Raju Singh @ Keshav Kumar, whose case was also on similar footing, was granted bail on 04.07.2018 in Cr. Misc. No. 30530 of 2018 considering the fact that one of the coaccused namely: Bablu Singh was granted bail vide Cr. Misc. No. 3546 of 2015. He further submits that one another accused namely- Abhishek Singh @ Kuku @ Abhishek Singh Kuku has been granted bail vide Cr. Misc. No. 74145 of 2018 on 11.12.2018.

Learned Additional Public Prosecutor has opposed the prayer for bail primarily on the ground that petitioner is a habitual offender and he was earlier accused in three cases. In reply learned counsel for the petitioner submits that those cases were of the year 2011.

Besides hearing, I have examined the material on record and after going through the same particularly the fact that number of other accused persons have been granted bail, there is no reason to further detain the petitioner. Let the petitionerManish Kumar @ Manish Singh @ Manish Kumar Singh @ Pravin Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- ( ten thousand ) with two sureties of the like amount
