The petitioner seeks bail in Jogapatti P.S. Case No. 273/2015, instituted for offence under Section(s) 366A of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence while the granddaughter of informant was alone at her house, this petitioner enticed her away.

Case diary has been received in this case from which it appears that police after investigation has submitted chargesheet against this petitioner. The girl has not been recovered. Learned counsel for the petitioner has submitted that in fact petitioner was married in the village of informant. Informant and family of father-in-law of petitioner have been at

Patna High Court Cr.Misc. No.74463 of 2018(3) dt.11-01-2019 2/2 loggerheads on account of land dispute. The granddaughter of informant has been working as maid from her childhood at the house of her familiar person at Miarwa, Siwan and just 5 to 10 days earlier she had come and left home. This fact can be borne out by the evidence collected during course of investigation and recorded in the case diary in paragraphs 5, 6, 14, 67, 68 and 83. Petitioner is in custody since 03.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran, Bettiah in connection with Jogapatti P.S. Case No. 273/2015, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
