The petitioner seeks anticipatory bail in connection with Mansi P.S.Case No. 254 of 2016, G.R. No. 2653 of 2016, registered for offences punishable under Sections 420, 409 of the Indian Penal Code.
Allegation as per F.I.R. is that the amount of Rs. 8,93,350/- was paid for construction of the building of the school but the work has not been completed and Rs 2,89, 266/- has been defalcated with 9% interest per annum of the said amount.
Submission of the learned counsel for the petitioner is that the petitioner has not committed any offence rather she has falsely been implicated in the present case due to wrong calculation of the expended amount and the petitioner is still
Patna High Court Cr.Misc. No.75980 of 2018(3) dt.29-01-2019 2/2 ready to complete the work which was entrusted to her. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances as discussed above, this application is disposed of with direction that if the petitioner is ready to deposit the rest amount i.e. Rs. 3 lacs within six weeks through the Bank Draft payable to the District Programme Officer and she will be released on bail to the satisfaction of the court concerned itself. The deposit of aforesaid amount will be the subject to the result of the case.
This application is accordingly disposed of.
