The petitioner apprehends his arrest in Hajipur Town P.S. case No. 34 of 2017 under Section 414 of the Indian Penal Code and under Section 30, 38, 47, 48 of the Bihar Prohibition & Excise Act, 2016.

The police intercepted a Sumo vehicle and arrested Jitendra Kumar Yadav and Rakesh Kumar and from their possession huge quantity of Indian made foreign liquor of different brands were recovered. The apprehended accused disclosed that the consignment was to be delivered to the petitioner.

It is submitted that petitioner was not apprehended on the spot. Nothing has been recovered from the possession of the

Considering the facts that on the basis of confessional statement of Jitendra Kumar Yadav and Rakesh Prasad, from whose possession huge quantity of Indian made foreign liquor was recovered, the name of petitioner figured in the case but nothing has been recovered from the possession of the petitioner nor the house of petitioner was searched, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in Hajipur Town P.S. Case No. 34 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
