The petitioner seeks bail in Tikapatti P. S. Case No. 2/2018 instituted for the offence under Section(s) 341, 323, 307/34 of the Indian Penal Code.
In the written report there is specific allegation against this petitioner of assaulting the mother of the informant with iron rod on the head causing serious injury. She was taken to different hospitals and in support of which different medical prescriptions have been enclosed with the bail petition which shows that doctor has diagnosed her and opined the cause of her death due to haemorrhage on account of such assault by iron rod.
Patna High Court Cr.Misc. No.70600 of 2018(4) dt.19-12-2018 2/2 Case diary has been received, wherein, the statement of the injured (mother of the informant) is available at para 22 of the case diary wherein she has also stated that this petitioner had assaulted with iron rod on her head causing serious injuries.
Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.
Trial Court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of six months from the date of receipt of copy of this order.
Petitioner may renew his prayer for bail in the event trial is not concluded within the aforesaid period. (Sanjay Priya, J) shyambihari/- U
