1. Heard learned counsel for the parties concerned.

2. Vide operative portion of the order, dated 07.02.2023, passed in CWJC No. 17861 of 2019, by this Court, the opposite party no. 5 was directed to refund the sum of Rs. 2,06,000/- + 10% of the consideration amount to the writ petitioner within a period of eight weeks.

3. The contempt has not been filed by the writ petitioner, but has been filed by the respondent no. 6 of the writ, who is

Patna High Court MJC No.2773 of 2023(4) dt.25-10-2024 2/2 a purchaser. In my opinion respondent no. 6 of the writ petition cannot maintain the present contempt application inasmuch as the order for payment by this Court was not in favour of the respondent no. 6.

4. In view of the aforesaid, this application, having no merit, stands dismissed.
