JUSTICE ARUN KUMAR JHA ORAL ORDER 27-09-2024 The present application has been filed for modification of order dated 17.02.2024 passed in Cr. Misc. No. 6876 of 2024 by this Court, whereby and whereunder the petitioner along with three other petitioners has been granted anticipatory bail and were directed to surrender within eight weeks.

2. Learned counsel for the petitioner submits that the petitioner could not surrender within the stipulated period as he had been suffering from Hepatitis 'C' from 13.02.2024 to 31.08.2024 and was advised to complete bed rest and for this reason, the petitioner could not surrender though other petitioners have surrendered in the learned trial court. Patna High Court CR. MISC. No.70859 of 2024(2) dt.27-09-2024 2/2 counsel further submits that not surrendering the petitioner within the stipulated period is neither intentional nor deliberate and prays for modification of the order by extension of time for surrender.

3. In the light of averments made in the petition as well as submission made on made on behalf of the petitioner, the period of surrender is extended for further four weeks.

4. Accordingly, the order dated 17.02.2024 is modified to the aforesaid extent only.

5. The present petition stands disposed of.
