The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

The petitioner and his son Vikash Singh allegedly assaulted with lathi to the father of the informant causing injury at his head as a result whereof he died. The post mortem report reveals that the doctor has found lacerated wound and a swelling at the right side and left side of the forehead respectively.

The post mortem report does not corroborate the prosecution allegation in the FIR that repeated assault on the

Patna High Court CR. MISC. No.68414 of 2018(9) dt.09-04-2019 2/2 head was made by the petitioner and his son. The petitioner is in custody since 26.05.2018 and is ready to cooperate with the trial.

Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.385 of 2018, arising out of Kochas P.S. Case No.91 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below. (b) The petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
