2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 392 and 411 of the Indian Penal Code, registered in connection with Matiyaria P.S. Case No. 4 of 2024.

3. As per prosecution case, some unknown miscreants have looted the motorcycle of the informant and his bag on the point of pistol.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR. The name of the petitioner has come into light on the basis of

Patna High Court CR. MISC. No.69260 of 2024(2) dt.08-10-2024 2/2 confessional statement of co-accused person, which has no evidentiary value in the eyes of law. No incriminating article has been recovered from the conscious possession of the petitioner. No T.I. Parade has been done. The petitioner is in custody since 25.01.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bettiah, West Champaran in connection with Matiyaria P.S. Case No. 4 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
