JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This application, for grant of anticipatory bail, arises out of Bhojpur Mahila P.S. Case No. 104 of 2019, disclosing offences under Sections 341, 323, 324, 498(A) of the Indian Penal Code.

Petitioner happens to be elder brother in law of the informant and allegation against him is that he in collusion with his brother, who is husband of informant and one Rita Devi, who is wife of petitioner used to assault and torture her in connection with demand of dowry.

Submission of learned counsel for the petitioner is that no further allegation has been attributed to the petitioner, who is elder brother-in-law of the informant and co-accused Rita Devi has been granted the privilege of anticipatory bail by the court below itself.

Patna High Court CR. MISC. No.61022 of 2019(2) dt.25-09-2019 2/2 Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhojpur, Ara, in connection with Bhojpur Mahila P.S. Case No. 104 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
