1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Magadh Medical Police Station Case No. 110 of 2023, dated 08.03.2023, disclosing offences under Sections 147/148/149/341/323/307/353/337/504 of the Indian Penal Code and Section 27 of the Arms Act.
3. The prosecution case, as per the First Information Report, is that a free fight took place between two groups of persons, who were engaged in firing and when the police personnel arrived there and tried to pacify the matter, the petitioner, along with other accused persons, pushed the
Patna High Court CR. MISC. No.68978 of 2023(2) dt.01-11-2023 2/3 police personnel and prevented them from discharge of their duties.

Learned counsel for the petitioner submits that upon perusal of the First Information Report, no offence under Section 307 of the Indian Penal Code is made out and only allegation that the petitioner, along with other accused persons, pushed the police officials, when they were trying to pacify the matter between the groups. He further submits that similarly situated accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court in Criminal Miscellaneous No. 37516 of 2023.
5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated accused persons have been granted bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each
