2. The petitioner seeks bail in Sahpur P.S. Case No. 289 of 2023 registered for the offence punishable under Sections-341, 323, 354A, 379, 504, 506, 34 of the Indian Penal Code.

3. It is alleged that while the informant's daughter went to attend tuition, the petitioner is said to have misbehaved with her and lifted her in his lap and tried to took her in Dhab but hearing the cry of informant's daughter, local people rushed to the place of occurrence and he fled away leaving his daughter.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.68758 of 2024(2) dt.08-10-2024 2/2 that the petitioner is innocent and he has falsely been implicated in this case. The petitioner is a business man and he has got no criminal antecedent. The petitioner has falsely been implicated in this case by the informant due to mala fide intention. The petitioner is under incarceration since 18-05-2024.

5. Learned APP has opposed the prayer for bail.

Considering the aforesaid facts and circumstances, especially clean antecedent of the petitioner and period of incarceration, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Kanchan Prabha, learned Judicial Magistrate-Ist Class, Danapur in connection with Sahpur P.S. Case No. 289 of 2023 with condition that the petitioner shall cooperate with the trial of the case and make himself available as and when required by the court.
