JUSTICE SANDEEP KUMAR ORAL ORDER 24-11-2023 This is the second attempt of the petitioner for grant of regular bail as earlier the application for grant of bail has been rejected vide order dated 15.03.2023 passed in Cr. Misc. No. 73639 of 2022.

2. Heard learned counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

3. The petitioner seeks bail in connection with Motipur P.S. Case No. 206 of 2021 registered for the offence under Sections 392, 397, 302 of the Indian Penal Code and under Section 27 of the Arms Act.

4. As per the prosecution case, this is a case of loot and murder and a part of the looted amount has been recovered from the petitioner.

5. Pursuant to the order dated 13.10.2023, the report of trial has been received from the trial Court and from its perusal it appears that the trial has started.

6. In view of the facts and circumstances, as mentioned above, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, the prayer of bail of the petitioner is rejected herewith.

8. The trial Court is directed to hold the trial on day to day basis and conclude the same at the earliest.

9. The Senior Superintendent of Police, Muzaffarpur is directed to co-operate in the trial by bringing the witnesses in the Court on the dates fixed by the Trial Court. Any failure in bringing the witnesses to the Court will be considered as violation of the orders of this Court.

10. Let a copy of this order be communicated to the Senior Superintendent of Police, Muzaffarpur through FAX and e-Mail for its compliance forthwith.
