Versus
The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s : Mr. Syed Ehteshamuddin For the Opposite Party/s : Mr. Sri Uday Chand Prasad ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 19-04-2017 Heard Mr. N.A. Samsi, learned counsel, assisted by Sri Syed Ehteshamuddin, learned counsel for the petitioners and learned Additional Public Prosecutor .
This is second attempt within a short span of period for grant of bail. Recently, on 22.12.2016 prayer for bail of the petitioners was rejected vide Cr. Misc. No. 50225 of 2016. The petitioners are in custody in Kotwali P.S. Case No. 307 of 2016 registered for the offence under Section 17, 18, 21 and 22 of the Narcotic Drugs & Psychotropic Substances Act, 1985. Learned counsel for the petitioner has drawn my attention to the order dated 17.3.2017 whereby petitioners' prayer for bail was rejected by learned Special Judge, N.D.P.S. Act,
Patna High Court Cr.Misc. No.17936 of 2017 (2) dt.19-04-2017 2/2 Gaya and after framing of charge, charge sheeted witnesses were summoned.
The court is of the opinion that since the prayer for bail of the petitioners was rejected only on 22.12.2016 and in the case after framing of charge, witnesses have already been summoned, there is no reason to review my earlier order. The prayer for bail again stands rejected.
