Mr.Sri Pranav Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-01-2019 The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 09.07.2018 passed in Cr. Misc. No. 35136 of 2018.

The learned counsel for the petitioner has renewed his prayer for bail on the same set of facts viz. that though the petitioner is alleged to be the assailant of the deceased, which fact has been confirmed by the informant who claims to be an eye witness to the occurrence but some of the witnesses whose statements have been recorded in several paragraphs of the case diary have stated that the assault was perpetuated by the others but the petitioner all through remained present.

Patna High Court Cr.Misc. No.76308 of 2018(3) dt.23-01-2019 2/2 Considering the statement of the informant who is an eye witness to the occurrence, I am not inclined to grant bail to the petitioner.

However, taking into account the fact that petitioner is in custody since 02.12.2017, this Court directs that the trial be concluded as expeditiously as possible, preferably within a period of six months. If there is no progress in the trial, the petitioner may renew his prayer for bail after six months.

The petition is disposed off with the aforesaid observation and direction.
