JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-10-2019 This application, for grant of anticipatory bail, arises out of Silao P.S. Case No. 113 of 2019, disclosing offences under Sections 341, 323, 324, 308, 506/34 of the Indian Penal Code.

Allegation against the petitioners is of assault to the informant by means of pistol, knife and iron rod, causing injury to him.

Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and no

Patna High Court CR. MISC. No.62132 of 2019(2) dt.01-10-2019 2/2 specific allegation has been attributed to them and although there is allegation of assault, however, the injuries sustained by the informant was found simple in nature, which is evident from Annexure - 4 of the petition.

Having heard both sides, considering the facts and circumstances, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda, Biharsharif in connection with Silao P.S. Case No. 113 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
