Mr. Shailendra Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2025 Heard learned senior counsel appearing on behalf of the petitioner and learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 65(1), 352, 351(2) and 3(5) of the B.N.S. and Sections 4 and 6 of the Protection of Children from Sexual Offences Act.

3. As per prosecution case, informant alleged that this petitioner established physical relations with her on the false pretext of marriage and later on, refused to solemnize marriage.

4. It is submitted by learned senior counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Petitioner has falsely been implicated

Patna High Court CR. MISC. No.64800 of 2025(3) dt.02-12-2025 2/2 in this case only with a view to put pressure upon him to solemnize marriage with the informant. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. with specific accusation that he established physical relations with the informant on the false pretext of marriage and later on, refused to solemnize marriage. The victim is a minor and in her statement recorded under Section 183 of the B.N.S.S., she has supported the prosecution case.

6. Considering the facts and circumstances of the case, specific and direct nature of accusation, gravity of offence and statement of the victim recorded under Section 183 of the B.N.S.S., the prayer for grant of anticipatory bail to the petitioner is rejected.
