JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-04-2017 The petitioner seeks regular bail in connection with Chhauradano P.S. Case No. 17 of 2017, registered for offences punishable under Sections 272 and 273 Indian Penal Code and Section 30(A) and 37(b) of the Bihar Prohibition & Excise Act, 2016.

Allegation against the petitioner is of recovery of 18 litres of Nepali liquor.

It has been submitted on behalf of the petitioner that though there is allegation of recovery of 18 litres of Nepali liquor, from the possession of the petitioner, however he has been sufficiently punished for the said offence as he has been in judicial custody since 30.01.2017 and has no criminal antecedent. Heard learned A.P.P. also.

No.17205 of 2017 (2) dt.13-04-2017 Having heard both sides, considering the facts and circumstances of the case, nature of offence and period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari, in connection with Chhauradaon P.S. Case No. 17 of 2017.

It is made clear if the petitioner again found involved in any of the offences, prosecution will be free to move for cancellation of his bail bonds.
