JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 20-08-2018 Learned counsel for the petitioner submits that now the appellate forum in the nature of State Appellate is available. In view of the above, he submits that liberty may be granted to the petitioner to approach the State Appellate Authority so that the petitioner may assist the Appellate Authority on facts as well as in the law.
In view of the above, the writ petition is disposed of with liberty to the petitioner to file appeal before the State Appellate Authority. In case, such appeal is filed within a period
Patna High Court CWJC No.20786 of 2013(4) dt.20-08-2018 2/2 of one month from today alongwith a copy of this order, the State Appellate Authority is required to decide the appeal on its own merit after condoning the delay in filing the appeal in view of the fact that the present writ application remain pending for the last five years.
