2. The accused/petitioner seeks bail in connection with Maner P.S. Case No. 476 of 2025 registered for the offences under Sections 137(2), 96, 3(5) of the Bhartiya Nyay Sanhita, 2023 (in short, the 'B.N.S.').
3. The accused/petitioner is named in the First Information Report and is in custody since 16.07.2025.
4. Allegation against the petitioner, who is lady of 21 years old, is to kidnap the minor son of the informant aged about 17 years for the purpose of illicit intercourse/marriage.

5. It is submitted by learned counsel appearing on behalf of the petitioner that victim was in love affairs with petitioner and out of said affairs, they visited different places of the country and finally they solemnized their marriage as per their own sweet-will in civil court, Patna.
6. It is pointed out that now the dispute and differences, which surfaced between the parents of the parties, appears settled and petitioner and victim son of the informant are living together as wife and husband.
7. While concluding argument, it is submitted that petitioner is a lady of clean antecedent and, moreover, investigation of this case is already concluded, for which chargesheet has been submitted and as such, there is no chance of tampering with the evidence.
8. Arguing further, it is submitted that victim after recovery stated in his statement recorded under section 183 of the B.N.S.S. that he solemnized marriage with the petitioner out of his own sweet-will and also negate the allegation of kidnapping.
9. Learned A.P.P. for the State duly assisted by learned counsel for the informant also supported the factum of compromise as arrived between the parties in view of submission as advanced by learned counsel for the petitioner.

In view of aforesaid factual submission and by taking note of the statement of victim, who negate the allegation of kidnapping and sexual assault against the petitioner, rather stated to solemnize marriage with petitioner, coupled with the fact that petitioner, who is a lady of clean antecedent, remains in custody since 16.07.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna/concerned court, in connection with Maner P.S. Case No. 476 of 2025, subject to the condition as laid down under Section 437(3) Cr.P.C/Section 480(3) of the Bhartiya Nagarik Suraksha Sanhita (in short "B.N.S.S.").
