====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Siwan Rail (Rail Siwan) P.S. Case No. 102 of 2019 for the offenses under Sections 401 and 414 of the Indian Penal Code. Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. He was apprehended by the police only on the suspicion that the petitioner was sitting along with three persons on the western side of Platform No. 4 in order to commit crime. In the instant case one knife was recovered from the possession of the petitioner. The petitioner is in custody since 15.05.2019.

Considering the totality of the facts and circumstances of the case discussed herein, the Court is inclined to grant bail to

Patna High Court CR. MISC. No.61499 of 2019(2) dt.27-09-2019 2/2 the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sonepur, Saran, Chapra, in connection with Siwan Rail (Rail Siwan) P.S. Case No. 102 of 2019.
