The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 342 of 2018 for the offences punishable under Sections 307, 302, 120(B)/34 of the Indian Penal Code. The allegation according to the FIR is that when the informant and his father were returning after having taken feast, on the way the petitioner and other accused persons, armed with country made pistol and rifle, surrounded them and fired indiscriminately due to which the father of the informant died on the spot.
The learned counsel for the petitioner submits that one co-accused Bishnu Mandal has been granted bail by this Court. I have heard the learned counsel for the petitioner and
Patna High Court Cr.Misc. No.69011 of 2018(4) dt.10-01-2019 2/2 perused the materials on record and I find that there is specific allegation against the petitioner and five other persons who indiscriminately fired upon the father of the informant who subsequently died, although the petitioner is also a named accused person, hence this Court finds that there is prima facie allegation of firing leading to death of the father of the informant.
Accordingly, the prayer for bail of the petitioner is rejected.
