2. The petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No. 280 of 2025 registered for the offence punishable under Sections 96, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita and Sections 4 and 6 of the POCSO Act.
3. As per the prosecution case, the petitioner is said to have eloped the minor daughter of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. There is no eye witness to the alleged occurrence. The
Patna High Court CR. MISC. No.67061 of 2025(3) dt.10-12-2025 2/2 petitioner is in custody since 18.07.2025.
5. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
6. From the statement of the victim girl, it appears that the she had eloped with the petitioner.
7. Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Court of POCSO, Siwan/ concerned Court in connection with Bhagwanpur P.S. Case No. 280 of 2025.
