The petitioner is in custody in a case registered for offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

It is a case of abduction of the victim-daughter of the informant. It is submitted that the petitioner has falsely been implicated in this case. The victim-girl recovered and from the perusal of the impugned order it appears that the victim-girl stated in her statement under Section 164 of the Criminal Procedure Code that she solemnized marriage with the accused Rohan Kumar, the petitioner. It is also mentioned vide paragraph 9 of the petition that the victim-girl has not corroborated the prosecution case in her statement under Section 164 of the Criminal Procedure Code. Patna High Court CR. MISC. No.65192 of 2022(2) dt.27-02-2023 2/2 victim has not whispered anything against the petitioner. The petitioner is in custody since 20.07.2022 having no criminal antecedent.

The learned Additional Public Prosecutor for the State opposed the prayer for bail.

Considering the aforesaid submissions, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Nanpur P.S. Case No. 319 of 2022 to the satisfaction of the Additional Sessions Judge VI-cum-Special Judge (POCSO Act), Sitamarhi.
