2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 414, 420, 465, 468, 471/34 of the Indian Penal Code.

3. As per FIR, the petitioner is alleged to have been apprehended on spot with a motorcycle bearing registration no. BR66B-1256 which is said to be stolen.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. It is further submitted that one Dulare Alam has given said motorcycle to the petitioner to repair and the petitioner after repairing the said motorcycle, was putting

He has got no criminal antecedent as stated in para-3 of the bail petition. Moreover, he is languishing in judicial custody since 2.8.2023.

5. Learned APP appearing for the State has vehemently opposed the prayer of Bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Motihari Town P.S. Case No. 531 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari.
