The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 447, 323, 326, 337, 302 of the Indian Penal Code and Section 27 of the Arms Act.
Petitioner is not named in the FIR. The informant is eye-witness of the occurrence.
Allegation is against the FIR named accused persons to have fired at the deceased Ajit Kumar causing injury and death during course of treatment.
Considering the aforesaid fact, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt
Patna High Court Cr.Misc. No.17450 of 2017 (2) dt.13-04-2017 2/2 of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar/successor Court in connection with Dumraon Police Station Case No. 171 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
