The petitioner, who is in custody, seeks bail in connection with Fulkaha P.S. Case No. 79 of 2017 (G.R. No. 2501 of 2017) registered for the offences punishable under Section 392 of the Indian Penal Code.

Informant who is working in Bandhan Bank Fulkaha as B.D.O. has alleged that on 21.07.2017 after collecting amount of Rs. 55,635/- he kept the amount in the dicky of his bike and when he reached Laxmipur Chowk, three miscreants riding on red coloured Apachi motorcycle stopped him. The miscreants on the point of pistol snatched away the Cash amount of Rs. 55,635/-, mobile, group Register, Poss machine etc. and fled away. Looted mobile has been recovered from possession of petitioner and Bike used in crime was also recovered.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail at this stage. Hence,

Patna High Court Cr.Misc. No.77898 of 2018(4) dt.29-01-2019 2/2 the prayer for bail of the petitioner is hereby rejected. Trial court is directed to expedite and conclude the trial within a period of six months from the date of receipt/production of a copy of this order.
