Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 38(1)(2)41(1) of the Bihar Prohibition and Excise (Amendment) Act, 2016. From a mango orchard liquor was, allegedly, recovered. Suspicion is that the same was of the petitioner. Petitioner has stated that the said liquor does not belong to the petitioner. The petitioner has no concern with the said orchard and he is in custody since 16.02.2017 and has got no criminal antecedent.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount

Patna High Court Cr.Misc. No.17880 of 2017 (3) dt.17-05-2017 2/2 each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Rosera, Samastipur/successor Court in connection with Hathauri (Shivaji Nagar O.P.) Police Station Case No. 22 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
