The petitioner seeks anticipatory bail in connection with Jalalgarh P.S.Case No. 115 of 2018, registered for offences punishable under Sections 363, 365, 370, 302, 201 and 120B/34 of the Indian Penal Code. Allegation as per F.I.R. is that two lady members of the informant, who had gone to the market but later on, their dead body was found.

Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is absolutely nothing against the petitioner and other similarly situated co-accused have been granted bail by different Coordinate Benches of this Court vide order dated 19.12.2018

Patna High Court Cr.Misc. No.76210 of 2018(3) dt.29-01-2019 2/2 passed in Cr. Misc. No. 55242 of 2018 and vide order dated 08.01.2019 passed in Cr. Misc. No. 78053 of 2018. It is also submitted that the petitioner has no criminal antecedent. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named on surrender or arrest within six weeks be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Prunea in connection with Jalalgarh P.S.Case No. 115 of 2018, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
