JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 14-11-2019 The Office has rightly pointed out the question of maintainability of this writ application in view of the provisions under the Armed Forces Tribunal Act, 2007. I do not find any reason to entertain this writ application at first instance for the grievance which the petitioner has raised and could have been raised before the Tribunal under the Act in accordance with the procedure prescribed thereunder.

This application is thus permitted to be withdrawn with a liberty to the petitioner to approach the Tribunal. It is indicated that if any question of limitation arises, the Tribunal shall consider condoning the delay as the petitioner
