The petitioner is apprehending his arrest in connection with Jalalgarh P.S.Case no.115 of 2018 , registered for offences punishable under Sections 363, 365, 370, 302, 201 and 120B of the Indian Penal Code.
Allegation as per FIR is of kidnapping of two ladies who had gone to the market but later on their dead body was found, FIR was lodged against unknown and during the investigation on the basis of the confessional statement of the co-accused, name of the petitioner transpired. Submission of the learned counsel for the petitioner is that except confessional statement of the co-accused, there is absolutely nothing against petitioner and one of the co-accused has been granted privilege of the anticipatory bail vide order
Patna High Court Cr.Misc. No.78053 of 2018(3) dt.08-01-2019 2/2 dated 2.11.2018 passed in Cr. Misc. No.59175 of 2018. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below within a period of six weeks from the date of order and on surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnia in connection with Jalalgarh P.S.Case No.115 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
