The petitioner seeks regular bail in connection with Deoriya P.S. Case No. 45 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding unknown accused persons having looted Rs.70,000/- from a bank.

The learned counsel for the petitioner submits that since his antecedent is bad, he has been falsely implicated in the present case and the recovery stated to have been made by the Police is in connection with other case bearing Kathaiya P.S. Case No. 82 of 2018 and no recovery has been made in the present case much less any T.I. Parade has been held. It is submitted that the petitioner is languishing in custody since

Patna High Court Cr.Misc. No.77050 of 2018(3) dt.18-01-2019 2/2 17.04.2018 in the present case and he is ready to abide by whatever conditions as may be imposed by this Court upon the petitioner.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Muzaffarpur in connection with Deoriya P.S. Case No. 45 of 2018.

It is further directed that the petitioner would mark his presence before the Officer In-Charge of the concerned Police Station at 10:30 A.M on each and every Monday of the week and on his defaults on two consecutive occasion to mark his attendance, the present privilege of regular bail shall stand cancelled automatically and the petitioner shall be taken into custody.
