The petitioner seeks regular bail in connection with Parsa Bazar P.S. Case No. 209 of 2018 registered for the offence punishable under Section 392 of the Indian Penal Code. The allegation is regarding the informant having been kidnapped by the accused persons when he had boarded on an auto rickshaw for travelling from Danapur Railway Station to Mithapur bus stand at Patna and thereafter he was taken near the bank of Punpun river where his mobile phones, cash and other articles were snatched and the accused had then fled away. The learned counsel for the petitioner submits that the petitioner is a non FIR named person and his name has transpired upon confessional statement of the co-accused
Patna High Court Cr.Misc. No.76760 of 2018(3) dt.11-01-2019 2/2 person, namely, Firdous who is in custody. It is further submitted that the informant has stated in his fardbeyan that three unknown accused persons had committed the aforesaid crime, and since three co-accused persons are already in custody, the fourth person i.e. the petitioner herein cannot be treated to be an accused in the present case. Lastly, it is submitted that the petitioner has a clean antecedent and he is in custody since 13.09.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Patna in connection with Parsa Bazar P.S. Case No. 209 of 2018.
