2. The petitioner apprehends his arrest for the offences alleged under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code, registered in connection with Kotwali (Barari O.P.) P.S.Case No. 939 of 2023.

3. According to allegation, the petitioner got his name mutated in the revenue records on the basis of forged documents.

4. The learned counsel for the petitioner has submitted that a civil suit is pending between the parties and ultimate

Patna High Court CR. MISC. No.69475 of 2024(7) dt.21-08-2025 2/2 remedy lies in the civil court, and not in criminal court.

5. The learned counsel for the informant as well as the learned counsel for the State opposed the prayer for bail by submitting that the petitioner got his name mutated on the basis of forged documents.

6. It appears to be a matter of civil dispute and ultimate remedy lies in the civil court.

7. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate Bhagalpur in connection with Kotwali (Barari O.P.) P.S.Case No.939 of 2023, subject to the conditions as laid down under Section 438(2) Cr. P.C/482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) HR/- U T
