2. The petitioners seek bail in a case registered for offence under Sections 341, 447, 323, 324, 354B, 379, 504, 506/34 of the Indian Penal Code.

3. According to F.I.R., on the order of co-accused Gaya Devi, petitioner no. 2 (Jalandhar Rai) assaulted on the head of father-in-law of informant with Lathi and petitioner no. 1 (Lal Babu Rai) assaulted one Mahesh Ray by means of Lathi on his head. It is further alleged that petitioner no. 2 (Jalandhar Rai) also assaulted Mahesh Rai with Lathi, causing injury on his left hand.

4. Learned counsel for the petitioners submits that both parties are Gotiyas and on account of land dispute, Maarpeet took place between the parties, in which, both sides sustained injury. Case and counter case. Petitioners have got clean antecedent and are in custody since 15.07.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Samastipur in connection with Chakmehsi P.S. Case No. 42 of 2023.
