The petitioner is in custody in connection with Dariyapur P.S. Case No. 239 of 2018 for the offences under Sections 363, 365 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 04.08.2018.

Referring to the prosecution case he submits that petitioner has been dragged in the instant case due to local politics.

The allegation against this petitioner is that with a view to grab the property of his brother and his wife at Haridwar petitioner has played mischief in this case as the brother of the petitioner was issue less and petitioner was pressurizing them the (missing duo) husband wife to transfer their property in favour of petitioner and his son.

Patna High Court Cr.Misc. No.76961 of 2018(3) dt.29-01-2019 2/2 Learned counsel for the petitioner submit that Shankar Bhagwan Singh was patient of mental disorder and also on previous occasion disappeared for 15 days.

Considering the fact that the petitioner is the brother of the Shankar Bhagwan Singh, he is missing alongwith his wife, the Court is inclined to grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Chief Judicial Magistrate 4th, Saran in connection with Dariyapur P.S. Case No. 239 of 2018 with the following condition:-

(1) Petitioner and his son shall not alienate any of the property of at the village or at Haridwar whether standing in the name of missing Shankar Bhagwan Singh or his wife or in the name of this petitioner.

(2) He shall extend full cooperation in the early conclusion of the trial, the trial Court is directed to take steps for early disposal of the case preferably within a period of nine months. In the event petitioner is found involved in delaying the trial or influencing the witness the Trial Court shall be at liberty to cancel the bail bond of the petitioner.
