====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Ghoghardiha P.S. Case No. 84 of 2018, instituted for the offence under Section(s) 394 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. During investigation, the name of petitioner has come on the basis of statement of spy. He further submits that co-accused Ram Prakash Yadav has already been granted bail by coordinate Bench of this Court vide order dated 26.02.2019 passed in Cr. Misc. 11270 of 2019.

Petitioner is in custody since 3.9.2018.

Patna High Court CR. MISC. No.77285 of 2018(4) dt.07-03-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jhanjharpur, Madhubani, in connection with Ghoghardiha P.S. Case No. 84 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
