The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code and Section 25(1-b)a/26 of the Arms Act. As per allegation in the FIR, while the informant was returning to his house, four miscreants encircled him and on pistol point they snatched his Rs. 600/-. On raising alarm by the informant, two of them were apprehended and they disclosed the name of the petitioner as of his associates. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. Petitioner was not present at the place of occurrence. Neither the petitioner has been put on

Patna High Court CR. MISC. No.69757 of 2022(2) dt.13-03-2023 2/2 TIP nor any incriminating articles have been recovered from the conscious possession of the petitioner. Apprehended accused namely, Aman Kumar and Rohan Kumar have disclosed the name of the petitioner before the police, which has got no evidentiary value in the eye of law. Petitioner has got no criminal antecedent. It is further submitted that he is languishing in judicial custody since 10.06.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Jakkanpur. P.S. Case No. 232 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1, Patna..
