JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 473 of 2016, disclosing offences under Sections 498(A) and 380 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand. Submission of learned counsel for the petitioner is that he is still ready to keep the complainant, but the difficulty is that he is working outside India, but he is ready to maintain her. Heard learned A.P.P. as well as learned counsel for the complainant.

Having heard both sides and in view of the submission made by both the parties, as both the parties are

No.78004 of 2018(4) dt.20-02-2019 2/2 agree on the point of maintenance till any maintenance case is decided, petitioner shall pay Rs.12,000/- (Rupees Twelve Thousand) per month payable by first week of every month to the complainant, as such this application is disposed of with a direction to the petitioner to surrender before the court below within a period of six weeks and on surrender he will be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of court concerned with condition that he will pay Rs.

12,000/- (Rupees Twelve Thousand) per month payable by first week of each month to the complainant, for that purpose the complainant has to supply her account number to the petitioner to enable him to pay the amount, till the maintenance case is decided by a competent court of law and it is needless to say that the petitioner has to cooperate in disposal of the case, otherwise the complainant is free to move for cancellation of his bail bonds before the court below itself. With the above direction, this application is disposed of.
