JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-10-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned A.P.P. for the State.

2. The petitioners have preferred this application for grant of regular bail in connection with Sherghati (Dobhi) P.S. Case No. 671 of 2023 dated 26.06.2023 registered for the offence punishable under Sections 147, 341, 323, 325, 307, 504 and 506 of the I.P.C.

3. As per the prosecution case, the petitioners and the co-accused persons armed with Lathi-danda came and assaulted

Patna High Court CR. MISC. No.67738 of 2023(2) dt.18-10-2023 2/3 the informant and his son causing severe head injuries. During the course of treatment, the informant died after one and half month.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioners have clean antecedent, as stated in paragraph no. 3 of the bail petition. There is general and omnibus allegation against the petitioners. There is case and counter case between the parties. The doctor has found simple injury on the person of the informant. It is further submitted that the informant was admitted to hospital on 25.06.2023 and after discharge on 04.07.2023 he was residing at his residence but on 13.08.2023, all of sudden, he become seriously ill and died. The petitioners are ladies. They are in custody in this case since 26.06.2023.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount

Patna High Court CR. MISC. No.67738 of 2023(2) dt.18-10-2023 3/3 each to the satisfaction of the learned Court concerned, Sherghati (Gaya), in connection with Sherghati (Dhobhi) P.S. Case No. 671 of 2023.
