2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 147, 148, 149, 307 and 302 of the IPC.

3. According to the prosecution case, all seven accused persons including this petitioner assaulted the father and brother of the informant by means of lathi, iron rod, and axe, due to which the father of the informant sustained injury and died on the spot, and the brother of the informant got injured.

4. It is submitted on behalf of the petitioners that as per FIR co-accused Jhigan Manjhi assaulted on the head of the father of the informant with tangi and this petitioner is alleged

Patna High Court CR. MISC. No.65408 of 2025(3) dt.03-11-2025 2/2 to have assaulted with hockey to the brother of the informant, petitioner is not alleged to have assaulted the deceased. Injury caused by this petitioner is found simple in nature. Similarly situated other co-accused persons namely Laljit Manjhi @ Loaljit Manjhi and Raj Manjhi @ Raj @ Nada have already been granted the privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 02.04.2025 passed in Cr. Misc. No. 17081 of 2025. Petitioner claims clean antecedent.

5. Learned counsel for the informant opposed the bail petition.

6. Considering the nature of injury caused by this petitioner, clean antecedent of the petitioner and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-VI, Nawada in connection with Hisua P.S. Case No. 478 of 2023, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) AjayMishra/- U T
