JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-11-2024 The present petition has been filed for modifying the condition imposed upon the petitioner by this Court, vide order dated 7.2.2023, passed in Criminal Miscellaneous No. 51575 of 2022, to the effect that the petitioner has been directed to appear before the learned Trial Court on each and every date so fixed in the ongoing case and in case of two consecutive defaults, the privilege of bail granted to the petitioner has been directed to be cancelled automatically.

The learned counsel for the petitioner submits that the petitioner has been religiously adhering to the aforesaid conditions for the past one year and seven months, however,

No.73549 of 2024(2) dt.22-11-2024 2/3 since now the petitioner has been transferred to Kaimur and is also pregnant, a sympathetic view be taken and she be permitted to appear before the learned Trial Court on each and every date so fixed in the ongoing case through her lawyer, nonetheless, she undertakes to appear in person, before the learned Trial Court, whenever she is directed to appear personally by the learned Special Judge Vigilance, Muzaffarpur, in connection with Vigilance P.S. Patna Case No. 25 of 2022. 3.

Per contra, the learned counsel appearing for the Vigilance submits that it is for this Court to take a call on the aforesaid prayer made by the petitioner.

Having regard to the facts and circumstances of the case and considering the submissions advanced by the learned counsel for the petitioner, I deem it fit and proper to modify the conditions imposed upon the petitioner, by the aforesaid order dated 7.2.2023 and direct that instead of the petitioner appearing before the learned Trial Court on each and every date so fixed, she shall appear before the Ld. Trial Court, in the ongoing case, through her lawyer on each and every date so fixed and in case, the learned Trial Court directs for her personal appearance she would appear in person before the learned Trial Court, without fail, in default whereof, the privilege of bail, granted to the

Accordingly, the present petition stands disposed off with the aforesaid modification in the order 7.2.2023, passed in Criminal Miscellaneous No. 51575 of 2022.
