1. Mr. Shubhesh Pandey, learned counsel appearing for the appellant submits that as the processes under Section 82 and Section 83 of Cr. P.C. have been issued against the appellant and he has made pre-arrest bail prayer in this appeal, so he wants to withdraw this appeal with a liberty to surrender before trial court and in this regard, permission is required.

2. In view of above prayer, the instant appeal stands dismissed as withdrawn with a liberty to the appellant to surrender before the trial court within four weeks, if he avails the liberty within the said period then the trial court shall decide
