The petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 18 of 2016 for offence under Sections 406 and 420 of the Indian Penal Code. Accusation is that the petitioner was appointed as a Manager of Nesh Guest House Institution by the informant who is the Managing Director of Nesh India Infrastructure Pvt. Ltd. 26, Kidwaipuri, Patna on 04.12.2015 for running the Guest House properly. In the course of time, Rs. 4 Lac was given to him on 08.12.2015 and he worked from 04.12.2015 to 18.01.2016 as Manager, all of sudden he left the Guest House on 19.01.2016. Later on, the informant came to know that petitioner has gone
Patna High Court Cr.Misc. No.17846 of 2017 (3) dt.08-09-2017 2/2 after taking Rs. 4 lac and collection of one and half month which is about Rs. 9-11 lac.
Learned counsel appearing on behalf of the petitioner submits that, in fact, the petitioner was appointed as Manager on 04.12.2015 and worked till 18.01.2016 but the salary was not paid to him. Thereafter, the petitioner left the job and due to that reason he has been falsely implicated in this case. He further submits that nothing has been collected by the investigating officer in the course of the investigation.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Patna in connection with Budha Colony P.S. Case No. 18 of 2016 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
