Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Begusarai Town P.S. Case No. 169/2018, instituted for offences under Section(s) 356 and 379 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence while informant was returning home on rickshaw after withdrawing Rs. 1,42,000/- from the Bank, all of sudden two miscreants on motorcycle came and snatched lady purse containing Rs. 1,62,000/-, Cheque-book, Pass-book, Voter Card, Aadhar Card, PAN Card and mobile set etc. and fled away. Patna High Court CR. MISC. No.76481 of 2018(3) dt.06-03-2019 2/2 26 of case diary witnesses, namely, Rehan Khurshid and Nadish Naman have supported the prosecution case and have claimed to identify the accused.

Learned counsel for the petitioner has submitted that petitioner was put on T.I.P. Copy of T.I.P. chart is annexed as Annexure-2, from which it appears that one Nadish Naman has identified one Ajay Kumar not the petitioner. Learned counsel for the informant has opposed the prayer for bail of petitioner.

Petitioner is in custody since 13.09.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai, in connection with Begusarai Town P.S.
