JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioners seek bail in anticipation of their arrest in connection with Dariyapur P.S. Case No. 99 of 2018 registered for the offence punishable under Section 394 of the Indian Penal Code.

As per FIR there is allegation of snatching of motorcycle of the informant by unknown miscreants and assaulting him. Petitioners are not named in the FIR. Submission of learned counsel for the petitioners is that except information of spy there is nothing against them and, that too, after one year of the occurrence and they have no criminal antecedent.

In view of above facts and circumstances, let petitioners surrender in the court below within a period of two weeks from the receipt of this order and on surrender they shall be released on bail by the court below itself on the condition that they have to appear before the I.O. immediately after their release and co-operate in the investigation, otherwise the prosecution is at liberty to move for cancellation of their bail bonds.

With the above observation, this application is disposed of.
