The petitioners apprehend their arrest in Atri P.S. Case No. 63 of 2019, registered for the offence punishable under Sections 341, 323, 308, 379 and 34 of the Indian Penal Code.

As per prosecution case, while the informant was going to attend the call of nature, in the meantime, all the three FIR named accused including these petitioners assaulted the informant with Khanti, Garansa and rifle etc., as a result of which, he sustained injuries on his head.

It is submitted on behalf of petitioners that petitioners have falsely been implicated in this case. There is case and

Patna High Court CR. MISC. No.60571 of 2019(4) dt.05-02-2020 2/2 counter case. There is general and omnibus allegation against the petitioners.

Considering the facts aforesaid and the fact that petitioners are named in the FIR and injuries found on the person of informant is grievous in nature, I am not inclined to enlarge the petitioners above-named on anticipatory bail. Accordingly, the same is rejected.
